This is what i suggest let us not accept kibaki as the president of Kenya this should include when addressing press conferences, it should go to civil society and anyone being interviewed. My president is Raila period.

ODM MP should make sure hon keneth marende is elected the next speaker of parliament. and in fact we should also have a deputy speaker of the parliament from the ODM. anybody from the smaller party who needs the support of ODM to be a deputy speaker like say GITOBU IMANYARA must never be accepted even if he promises to join our stuggle. Promises in politics are never fulfilled.We needed these people before the general election but there were not there when we needed them most.
Kaemilio kibaki has beenhiding in the state house but he will have to come to parliament to official open the august house, Here he should at least come to taste the bitter pil of illigitimacy, He should never be acoorded the honour beffiting a head of state but should be treated like a thief in the street . We truly have to show the world that we are not happy. Peaceful Mass Action after very serious considerations is the only sure way out. Thanks for the 3 days of protests in more than 20 locations across Kenya. The people need to be addressed. We need to cripple Nairobi economically. Probably the middle class will get the message when they feel the pinch. Cripple Nairobi and the rest of the country suffers. We need to maintain peace though. No looting, intimidation, violence or killings

All Kenyans must share in their resources equally. All Kenyan communities have a God-given right to have one of their own vie for and become president of Kenya if elected.
It is totally unacceptable that Kikuyus are the the exclusive rulers while the other Kenyan tribes are to remain the ruled. They are bribing soldiers and police to be loyal to them. Of what value is a KSh 10,000 bribe to an officer if his or her kinsmen are being killed or discriminated against.
Kibaki is relying on bribery to survive. He bribed voters but he was still rejected. He is bribing even the security officers to kill for him.
ODM must not let Kenyans – current and future generations – down. If the international community cannot help Kenyans, then Kenyans have to fight for their rights.
Kibaki is a regional leader. ODM must take control of its regions and collect taxes and run a government.
It will be the only language Kibaki, PNU, and the now-expanded GEMA will understand loud and clear.
What does one go to parliament for? To debate and pass what sort of bills? If you are not genuinely free in your own country, then you have to fight to be free first – to have equal access to opportunities like Kibaki’s people.
The Kenya of today is not a real and durable country. I have gone around some parts of Kenya. The population is growing and land, the only source of earning a living, is becoming more and more scarce.
The Kenya of tomorrow will explode. There is no doubt about it unless Kenya gets unselfish rulers to lead a Kenya of all tribes and races.
Kibaki has gone back to his ethnocentric tendecies – refusing to let any other Kenyan apart from GEMA be in chjarge of the Ministry of Finance, Internal Security and Provincial Administration, and Public Works, where big money will be handled.

dialogue is impractical based on Kibaki’s and PNU way of doing things i.e their way or forget it. secondly dialogue for purposes of government of national unit requires demonstrated commitment and viable or workable options. in this case cabinet has already been appointed and so the action is moot.
mass protests, demonstrations although meant to be peaceful and well intended are being broken up by forces resulting in violence (even the women demonstrators in Coast last week and the women demonstrators in Nairobi this week are broken up by armed riot squads) which in turn degenerates into revenge violence attacks on communities deemed sympathetic to PNU/Kibaki elsewhere as well as innocent bystanders. this does not help ODM’s image either.
Results from last three elections show all other provinces are willing to vote and work with leaders outside of their communities except for Central Kenya. Central kenya has obstinately voted only for their own community no matter what. We need to stop lying to ourselves a time will come when they will. I suggest perhaps foolishly to split the nation or secede and have central/eastern as one unit and the rest to be a new nation for united free and democratic people of africa.
lets leave central/eastern kenya with their rulers and corrupt and skewed institutions. ODM can go to parliament to formalize the breakoff details. I’m tired of conflict, corruption and dictatorships all the time while the rest of the world moves on. We can never get consensus with Central Kenyans, and the few moderate and progressive democratic minded from these communities ironically become the target of hate both from their own communities as well as the others who perceive them unfairly as untrustworthy. we’ve been fighting for ages to get control of govt and public resources so that we can straighten out these institutions to provide what is basic rights of the people but keep hitting this brick wall first is was ford splitting to ford asili and ford kenya now its ODM vs ODM-kamba and central leaning PNU. We need all other tribes but if the ODM ers from Luo Nyanza and Uasin Gishu continue to destroy their livelihoods who will ever trust them, award contracts or employ even the elite. People from various walks of life will imagine anybody from Luo Nyanza or Uasin Gishu will burn the office incase of a dispute.

I am so angry! I’ve been angry, depressed and then twice as angry since the 30th of December. I get even angrier when Afred Mutua, Danson Mungatana, Amos Kimunya, MARTHA KARUA, KALONZO MUSYOKA, MWAI KIBAKI, purport to speak for the ordinary Kenyan. That is you and me! The fourth Estate depress me with the calls for peace as do Bethuel Kiplagat and Sumbeiyo and I can’t help but ask myself how anyone can ask me to live my life as I did before my vote was stolen and a president forced down my throat! I keep asking myself why all these people can not see that Kenyan’s are angry very angry and until we get rid of that anger no solution no matter how divine will heal this country for the majority of us who wanted change and very emphatically announced it to the world via the ballot box. The best way forward is to stop issuing any press conferences by top ODM personlity. Let Salim lone do the talking. RO should not be seen for an even longer time.Infact if he is seen, let him be seen in Kisumu and Eldoret calming people down and promoting peaceful demonsttrations only.
Also,let them retreat for a good 3-5 days without giving MK any contact or any information. Keep him in the dark and do a groundwork campaigns in the whole of Kenya.That way, ODM can feel what the eletorate really wants. Otherwise, the illegal government is just wasting time.

i am abit disheartened by the new generation now most of the young people now are shy of coming out and asking for good governance look at the generation who fought for multy party in 1992 the Raila’s, Anyang Nyongo, Mukhyisia Kituyi,Wanyiri Kihoro,Kiraitu, Muite,Orengo,Ngilu,Shikuku and many more are all in there mid 50’s to early 60’s now 15 years down the line it is a shame that the some of this people are still keeping the liberation torch burning for us and yet we young people in our 20’s, 30’s and 40’s are happy to be content when looters are taking our money and corruption is rampant dear bloggers Kibaki stole this election from us where are the new generation of leaders like the Njoya’s, Kivutha’s of the yesteryears to take the mantle of ensuring justiceis done our colleges which were involved in bringing change in the 80’s students like Wafula Buke, Mghanga who will replace them we should take that leadership starting from wenesday next week.

This is my take on the current situation in Kenya :-
the fight here is not ethnic as we are forced to believe; it is about INJUSTICE- it is between the forces for change and those for the status quo. In the former group is the ODM and in the latter is PNU/KANU; these two parties have one thing in common, not only in their names, but also in the personalities composing them; a UNION of rich old guards and their opportunistic foster/biological sons. This grouping cuts across ethnic borders in a similar way it did since its inception by the founding president Jomo Kenyatta. It was designed to do what it experienced today- keeping the poor poorest and the rich richest and oppressing those championing real change for civilians. It is not worth stating that KANU is technically back in power, courtesy of the FIRST FAMILIES and their RICH network.
We must therefore understand that this group of KANUist have a common interest of protecting their ill acquired wealth. This has nothing to do with a peasant Kikuyu/Kalenjin/Luo/Luhya/Kamba/Maasai and the rest, for they don’t benefit at all from the loot, but are being used through negative ethnicity to protect thieves from their respective communities. Ask yourself, how is Kalonzo’s VP’s position going to help Eastern province in general and Ukambani in particular, without good policies in force?
The way forward is therefore very clear;we are going to accept nothing but justice, at whatever cost. Kenyans spoke decisively for change and the verdict is that we won. There is no amount of negotiation that will earn us our right, it must be combative and even brutal both in words and action, for that is the language THIEFS understand. The way forward is to focus our energy and resources( human,financial and intellect )on ways and means to ensure the so much yapped about economy is crippled to the extent that the thief ,impostor president and the back door government would not operate ( starved off revenue ).It is clear ODM won in all the provinces except two,therefore peaceful protest through mass action in the six provinces,the middle class not reporting to work in solidarity ( strike) people should stop going to work but join in the protest through the streets.
The middle class is the letdown ,mainly because of fear of losing their jobs and the comfort zone but better comfort would be attained if we all participate in the protest to ensure we get what is rightfully ours i.e ODM government in it’s rightfully place.
ODM should see how it’s supporters can acquire protective gear against the teargas and pepper laced water cannon .Supporters can come up with ideas on how to mobilise if possible overnite to the venues to beat the security detail and once there stay put camp in the venues until this” SHRIEK” steps down,the cops are human beings they would get tired.ODM needs to infiltrate the force and sweet talk the cops and security forces not to harm their fellow Kenyans and join the rest of the Kenyan people by refusing to be abused ,in other words downing their tools ,desert and join the massess in protest.

Our passion for change is relentless. However, my concern is whether we are likely to get the best solutions without going the Rwanda, Congo, Somalia, Sudan…ways.
Sometimes we use a very strong language on this blog which suggests that we are not likely to bring about the change we desire-in a more civilised way. Lessons around us show that guns and bombs never brought democracy. Show me one coutry that has earned democracy and justice through this way. All world heroes for a just world including Martin Luther King Jr, Mandela, Mahthma Gandhi, Orange Revolution Ukraine,……….name them, are icons because of the non-violent approach to disputes. Assessing from fellow bloggers here, we are totally divided and I personally find arguments for guns and bombs not one befiting a Raila president.
In addition, we shall be frank here, I have been doing some media analysis and reporting about the conflict. I will tell you that the reporting has this ethnicised flavour. I want to tell us that as the country is falling apart, ODM members need not fall into this category. How possible? I got an email suggesting that this blog is basically a Luo Nyanza affair. So I sought to do a further analysis and I established that it is not necessarily true. We have people from different ethnic groups who are in support of RAO irrespective of ethnicity (6 provinces at least). But that is not to suggest that it is clean. How can we sustain this support without making people from other provinces think like, Ok this is a fight between luo and kikuyu and not democracy? I have started feeling like this attitude is emerging as the media continues to portray it that way. Democracy is for all of us and we should endeavour to nurture it that way. I hope someone is getting my point.
Moreover, the message of hope and peace must not leave our fingertips. Hope that Kenya will never come down. Hope that we shall live together again as brothers and sisters without being judged by the twist of tounges. Hope that Kenya will remain as the eye of prosperity in Africa and an example of all other nations around us. Please preach hope and not doom.
Lastly, I agree with Kawere. Raila should vanish from the limelight and leave things to Lone. Kibaki has left all the cheating to Mutua. I agree with that strategy. Raila shouldd not appear desperate. He should go out to Kisumu and Eldoret in a calm way. He should reach out to the business community and see how they are going to rebuild the fallen cities. That is the work of a presidential candidate. Let Lone do the talking.

I believe that President Kibaki should resign from the Presidency, and let the ECK and the World Community body recount the Presidential votes with accuracy, to determine who exactly won the Presidency of the Republic of Kenya. I believe that President Kibaki is getting bad influence from the former Kanu Regime, and should try to act democratically, since the recent elections reflected the peoples Republic choice. We need to avoid bloodshed and ethnic strife and tensions and I think we have to call it as it is, 90% Central/Eastern voter will vote one of their own. We can wait for 2012 and 2017 for repeat performance and validation, In the meantime thousands more lives will be lost or at risk due to ethnic divide, and mistrust and revenge attacks continue.
Dont get me wrong and I want amicable resolution, but if Kibaki does not come up with some mega solution, and the PNU guys continue to point fingers at ODM then we are going nowhere.
Rightfully or just an extension of 2002 mandate, Kibaki is the head of state and the amicable resolution and end of this impasse is in his court, all the resources revolve in his backyard. He has chosen to use strategy no 1 excessive force whereas there were other alternatives which was a poor choice. dangling/dishing out cabinet posts which is strategy no 2 is also not reasonable choice and both express arrogance and scorn towards those aggrieved. strategy no 3 is wait it out and in the meantime ban all rallies/media generally frustrate any opposition. In the meantime there are very insincere and half hearted moves at “dialogue”. and finally strategy 5 “mta do” i.e seek legal redress in any of the PNU controlled institutions
Shamaqmaya, I support your suggestion of a national sit in/strike no one can force us to work but for it to be effective it must be supported by some form of peaceful demonstrations.
This was the time for Uhuru, Muite and Kalonzo to stand up and be counted. PNU with 43 MPs is a minority. The 15 ODM-K and the 34 MPs from the fringe parties should have supported ODM (the party with majority) in a vote of no confidence against Kibaki’s attempt to rig himself back. But they chose the easiest option of supporting a thief and yet some of them proclaim that they are Christians and champion democracy!
Kalonzo’s action is unfortunate but he cannot serve under a dictatorship for 20 years and claim to be a reformist. Raila was spot on when he said Kalonzo was part of the problem, he is one of the moles Moi planted to dismantle the opposition.
We still have a long way to go but a few house keeping decisions must be made. First Kibaki must be rejected by all Kenyans who care for democracy. If we fail this time we shall have set a precedence that we will leave to regret. We must say no to a rigged poll at whatever cost and the middle class must participate and be prepared to sacrifice. Secondly the electoral commission must be reformed and some decision made on how voting will be supervised in areas perceived to be hostile to the electoral agents. Kivuitu and his team are a disgrace and they should resign immediately enmasse.
Then and then only then should we conduct a re-run and this time all ODMers must ensure a huge turnout because if the elections are free and fair we shall accept the results. And I repeat only if the elections are free and fair shall we accept the outcome, otherwise we shal make it very difficult for anyone to govern this country through rigged results! Kibaki must brace himself for a long haul of resistance against his unlawful rule. We did it to Moi and we shall do it again to Kibaki. He should also see what is happening to Charles Taylor now before he turns Kenya into a killing field!

ODM must immediately call for the impeachment of Kibaki and at the same time demand that Kivuitu be arrested and charged with treason. Let me address Kibaki’s issue first. KIbaki has lost the moral authority under all circumstances to govern. In the course of his first term and now capped with stealing the election, he has shown that he is the most dangerous perosn to the very existance of the Kenyan nation.
The ODM secretariat and the ODM Minister of Foreign Affairs should take the lead and Kenyans everywhere must support them in writting petition letters – email letters, snail mail letters – to:

begging the world and the international community to:
a) help the people of Kenya in their quest for their human and democratic rights – God-given right to life and God-given right to choose their leaders
b) help the people of Kenya have an equitable say in their government
c) help the people of Kenya have access to equal opportunities to employment and business opportunities
d) call upon Museveni of Uganda not to interfere in the affairs of Kenya
e) put in place an immediate travel embargo on Kibaki’s ministers and officials
f) put on hold, with immediate effect, any dealings or funding to the Kenyan government until a coalition government acceptable to all parties and mediated by the world has been put in place
g) accuse and take action against Kibaki’s officials – John Michuki, the Internal Security PS, and Police Commissioner Ali Hussein for crimes against humanity for ordering the execution of hundreds of Kenyans who were legally protesting blatant violation of their democratic rights

URGENT: 3000 NRA in Kenya ahead of rallies

Museveni on reuest by Mr. Kibaki has sent 3,000National Resistence Army troops to Kenya to assist Kibaki ahead of the ODM rallies. They left Uganda on the night of 12th January 2007 after a secrect consultation meeting among the NRA top oficials at the NRA headquarters near National Assembly in Kampala.
Meanwhile, PNU is supporting Mungiki and a section of Police officer develop petrol and other chemical bombs which will be thrown to some building in Nairobi, Kisumu, Eldoret and Mombasa and put blame on ODM to justify an arrest of top ODM Pentagon members particularly Ruto and Raila.

I am writing with a heavy heart full of tears which have refused to come through the eyes. I am very sad my fellow Kenyans and much more sad for being Kikuyu. However, I have consolation that Raila is The People’s president. How could Kibaki brazenly rig himself into the presidency fully knowing that he could never have been president had it not been through the charisma of Raila Odinga who marshalled former KANU MP’s to rebel against Moi’s chosen heir?. Throughout the tallying process, Raila had overlapped Kibaki and it is impossible for Kibaki to turn the tables no matter how he fared. What foxes me is how Kenyan voters could collude to give Raila full command of the house and reject him for the presidency. Never in a hundred years did Kibaki win the presidency. Every morning before leaving for work, I look at Raila’s picture with my son which was taken when he addressed Kenyans and the international community at the university of Toronto. My heart continues to swell because tears cannot come to my eyes.
Mr. Mwai Kibaki has degenerated from a reformer to a ”Toad King”. This process begins with the President becoming insensitive. Look at this pattern; he has broken one pledge after another without feeling a thing. And, as he does this, the question in his mind is: Where can you take me? In the case of the MoU for instance, we took him nowhere. The
begrudged politicians yapped until the cows came home. He put his portrait on our currency even after pledging he would do that and we took him nowhere. He pledged for a free and fair election and one of his pledges was to guarantee security to Kenyan but what are we seeing now, blood shed, live bullets preferred for Kisumu residents , while tear gas and rubber bullets for the rest of the country. Look at his government of national unity, GNU indeed, it’s a GEMA unity. The general attitude here is this: If you do not like it, you can sit on a pin!
Numbing his sense to popular voices has definitely degenerated into a state of paranoia. He is making one blunder after another. And instead of correcting his mistakes, he
will increasing his speed in the direction of the wrong.
At the risk of sounding crazy, I want to suggest the following: If we thought that Mr. Moi would plunge the country into civil strife, he proved us wrong. Kibaki is the Toad King to plunge the country into civil strife. It is my hope that the international community will have had time to reflect on the issues in Kenya.
All his cabinet and their families should be slapped with a travel ban so that they stay with us in this burning country. They made the bed so let they lie on it with us. ”Toad King”- Kibaki must be forced to step down. You can never fight DICTATORSHIP with DEMOCRACY.

I am matching to Uhuru Park on Wednesday. I am tired as a woman of this nation! I am tired of having to live in fear as I do. What will happen to my children when I am not here finally? I am going to safely park my car in the shed and match to Uhuru Park with those people from the other side of town! At the end of it all I am going to sit down with them and celebrate that elusive victory.

I really made noise for ODM last year and for sure we won, but the battle did not end there. We have to go that extra mile. Let Kibaki not think that he is holding us hostage in this country. He too is a hostage at State House. I he going to rule from state house with military police on the streets for 5 years? NO! Kibaki is not going to govern this country Mugabe way, Kibaki is forgetting that President Mugabe of Zimbabwe is having a backing of three quarters of Zimbabwe people behind him. The desire for peace is not something we can pass blithely upward, asking our leaders to deliver it. It is not something to pray for in others, when we harbour hate in our own hearts. Peace is not some hypothetical dream state: it is achieved by people being peaceful.
It is easy to be peaceful when there is nothing to be angry about. When things are fine. But the time to deliver is precisely when there is hatred, injury, doubt, despair, darkness and sadness.
We are in such a time today, and those people who are going to sow the seeds of love, pardon, faith, hope, light and joy need to stand up and be counted. Otherwise we will descend into tit-for-tat posturing and violence that we may regret for generations.
The mostly affected are now the lower class, the middle class are on queue as businesses close down coz of poor business. The employers will not be able to sustain their workforce. Let us recognize first that there is plenty that ails this nation. We have been badly let down by the murky manipulations and sordid schemes of our political leaders. We know that our institutions do not act in the interests of the common people, many of whom have just had horrific violence visited upon them merely because of the names displayed on their identity cards. Thousands have lost their property and their livelihoods, through no fault of their own. Parents have lost their little children in unspeakable circumstances.
There is much to be angry about, and many of us find the rage difficult to contain. And yet, this is precisely the time to live up to the higher purpose of the human being. There is a savage that lurks deep in all of us, and there are times when that savage rises to the surface and finds violent expression.
The history of mankind is characterised by brutal outbursts of mindless violence, often targeting the most vulnerable and the most helpless. If our lives have a point, it is to rise above the urge to take revenge, to harbour resentment, to feel mindless hatred. In Kenya, we did not seem to get terribly angry when public money was routinely stolen by cabals of leaders; when land was parcelled out inequitably; when the rot of corruption was weakening our courts; when we repeatedly failed to design a constitution to protect our rights.
Why then are we now angry at our neighbours for the way that they voted? The roots of this problem lie way back in our past, but our anger is directed at people we meet in the streets today. That is foolish and misguided. We are in this terrible place because we ourselves have tolerated low standards of behaviour for too long. That is why we must all become instruments of peace: because the fault is collectively ours, not that of some convenient bugbear out there.
To be an instrument of peace is not to be weak; it is indeed to be stronger than any other. It is to do the right thing when others are failing the test. It is to resist the temptation to fight fire with fire, to counter deceit with deceit, to take an eye for an eye. It is to understand that we must not die with blood on our hands; that life only has meaning if we leave it a little better than we found it.
It is time for Kenyans to rise to become instruments of their own peace; but to understand that that peace will not come from putting sticking-plaster on ancient wounds. For true, lasting peace to come, we will have to re-imagine this country: what it stands for and believes in; how it is led, and by whom; how it is managed and protected from itself; and how it grows and prospers for the benefit of all.
That immense task begins with one very small step: holding out a hand of compassion and succour to those who have been harmed, irrespective of who they are.

I was dismayed by the people who heckled senselessy Maina Kiai just because he stands by the truth that Kibaki stole the prezzy can this people who were displaced say they are better than those who chased them why shout at a person whose work is to come and compile a report on the atrocities commited on them and what about Kibaki himself who was addressing wananchi when there houses were being burnt down just 200m away they should have booed the thief(prezzy) out of the podium.

I was also shocked but not surprised at what happenned to Maina Kiai and teh Commissioners. This is what has also happenned to some ODM supporters from Central and even Kisii who have been sent away from their homes on blanket accusations. It is why ODM should find out for us some more sophisticated ways of protesting eg how can we make Kimunya, Karua, Mutua feel the pain we are feeling? How can we counter teargas when we conduct peaceful demos? How can we fund the brave and the media campaigns? etc
My conclusion is that ODM and all their supporters should think outside the box. I believe there are myriad ways to address this issue with serious consequences on the Kibaki bootlickers than just going out to the streets. I believe with all my heart that these people will not bulge until some real pain is inflicted on them personally. Even a cat when connered can really be dangerous. This is what lesson this ill-sworn in government should start learning. ODM and its team should think again. It might not be as obvious as it may look. Some real intelligent moves will crack this stalemate.
I could not believe what I heard from a campaigner of PNU (Mutahi Kagwe’s right hand man). Accordingly, he gave me the following points:
1. That Kibaki had accepted defeat earlier on the day he was announced the winner
2. That Kibaki’s cronies refused at all cost to hand in power to Raila. They told Kibaki that if he was not to be inaugurated as the country’s president, then the power was to go to the millitary but never to Raila.
3. That the current situation in RV Province is being instigated by PNU to enable them charge Ruto in the International Courts for genocide. Read UN involvement in the distribution of Food to the affected families.
3. That no matter how hard or fowl ODM cries, power shall never,at whatever price or cost, be given to Raila Amollo Odinga.
4. That US and some few European countries are supporters of Kibaki and ODM should forget about their Orange Revolution.
5. That Coast province is slowly becoming a PNU zone, and very soon they will ensure this by nominating Taib to parliament and giving him a powerful ministry to counteract the Balala’s influence.
6. That Mudavadi is sympathetic to violence affected individuals and may soon be a target to bring Western on board PNU’s boat.
7. That NEP is already a PNU zone.
9. That Museveni is playing a very crucial role to malign Luo Nyanza (read the death of Southern Sudan’s hero, the late Garang).
10. And that one of the rigging mechanics vis a vis Mutahi Kagwe to replace the just sacked Stanely Murage as the president’s adviser.
All these to me sounds logical and ODM, if you have any surprises to unleash, please do it now.

Kivuitu letter
An Open Letter to Samuel Kivuitu, Chair of the Electoral Commission of Kenya
Mr. Kivuitu,
We’ve never met. It’s unlikely we ever will. But, like every other Kenyan, I will remember you for the rest of my life. The nausea I feel at the mention of your name may recede. The bitterness and grief will not.
You had a mandate, Mr. Kivuitu. To deliver a free, fair and transparent election to the people of Kenya. You and your commission had 5 years to prepare. You had a tremendous pool of resources, skills, technical support, to draw on, including the experience and advice of your peers in the field – leaders and experts in governance, human rights, electoral process and constitutional law. You had the trust of 37 million Kenyans.
We believed it was going to happen. On December 27th, a record 65% of registered Kenyan voters rose as early as 4am to vote. Stood in lines for up to 10 hours, in the sun, without food, drink, toilet facilities. As the results came in, we cheered when minister after powerful minister lost their parliamentary seats. When the voters of Rift Valley categorically rejected the three sons of Daniel Arap Moi, the despot who looted Kenya for 24 years. The country spoke through the ballot, en masse, against the mindblowing greed, corruption, human rights abuses, callous dismissal of Kenya’s poor, that have characterised the Kibaki administration.
But Kibaki wasn’t going to go. When it became clear that you were announcing vote tallies that differed from those counted and confirmed in the constituencies, there was a sudden power blackout at the Kenyatta International Conference Centre, where the returns were being announced. Hundreds of GSU (General Service Unit) paramilitaries suddenly marched in. Ejected all media except the government mouthpiece Kenya Broadcasting Corporation.
Fifteen minutes later, we watched, dumbfounded, as you declared Kibaki the winner. 30 minutes later, we watched in sickened disbelief and outrage, as you handed the announcement to Kibaki on the lawns of State House. Where the Chief Justice, strangely enough, had already arrived. Was waiting, fully robed, to hurriedly swear him in.
You betrayed us. Perhaps we’ll never know when, or why, you made that decision. One rumor claims you were threatened with the execution of your entire family if you did not name Kibaki as presidential victor. When I heard it, I hoped it was true. Because at least then I could understand why you chose instead to plunge our country into civil war.
I don’t believe that rumor any more. Not since you appeared on TV, looking tormented, sounding confused, contradicting yourself. Saying, among other things, that you did not resign because you “did not want the country to call me a coward”, but you “cannot state with certainty that Kibaki won the election”. Following that with the baffling statement “there are those around him [Kibaki] who should never have been born.” The camera operator had a sense of irony – the camera shifted several times to the scroll on your wall that read: “Help Me, Jesus.”
As the Kenya Chapter of the International Commission of Jurists rescinds the Jurist of the Year award they bestowed on you, as the Law Society of Kenya strikes you from their Roll of Honour and disbars you, I wonder what goes through your mind these days.
Do you think of the 300,000 Kenyans displaced from their homes, their lives? Of the thousands still trapped in police stations, churches, any refuge they can find, across the country? Without food, water, toilets, blankets? Of fields ready for harvest, razed to the ground? Of granaries filled with rotting grain, because no one can get to them? Of the Nairobi slum residents of Kibera, Mathare, Huruma, Dandora, ringed by GSU and police, denied exit, or access to medical treatment and emergency relief, for the crime of being poor in Kenya?
I bet you haven’t made it to Jamhuri Park yet. But I’m sure you saw the news pictures of poor Americans, packed like battery chickens into their stadiums, when Hurricane Katrina hit Louisiana. Imagine that here in Nairobi, Mr. Kivuitu. 75,000 Kenyans, crammed into a giant makeshift refugee camp. Our own Hurricane Kivuitu-Kibaki, driven by fire, rather than floods. By organized militia rather than crumbling levees. But the same root cause – the deep, colossal contempt of a tiny ruling class for the rest of humanity. Over 60% of our internal refugees are children. The human collateral damage of your decision.
And now, imagine grief, Mr. Kivuitu. Grief so fierce, so deep, it shreds the muscle fibres of your heart. Violation so terrible, it grinds down the very organs of your body, forces the remnants through your kidneys, for you to piss out in red water. Multiply that feeling by every Kenyan who has watched a loved one slashed to death in the past week. Every parent whose child lies, killed by police bullets, in the mortuaries of Nairobi, Kisumu, Eldoret. Everyone who has run sobbing from a burning home or church, hearing the screams of those left behind. Every woman, girl, gang-raped.
Do you sleep well these days, Mr. Kivuitu? I don’t. I have nightmares. I wake with my heart pounding, slow tears trickling from the corners of my eyes, random phrases running through my head:
Remember how we felt in 2002? It’s all gone.

I wake with a sense of unbearable sadness. Please let it not be true…..
Meanwhile, the man you named President cowers in the State House, surrounded by a cabal of rapacious power brokers, and a bevy of sycophantic unseated Ministers and MPs, who jostle for position and succession. Who fuel the fires by any means they can, to keep themselves important, powerful, necessary. The smoke continues to rise from the torched swathes of Rift Valley, the gutted city of Kisumu, the slums of Nairobi and Mombasa. The Red Cross warns of an imminent cholera epidemic in Nyanza and Western Kenya, deprived for days now of electricity and water. Containers pile up at the Port of Mombasa, as ships, unable to unload cargo, leave still loaded. Uganda, Rwanda, Burundi, Southern Sudan, the DRC, all dependent on Kenyan transit for fuel and vital supplies, grind to a halt.
A repressive regime rolls out its panoply of oppression against legitimate dissent. Who knew our police force had so many sleek, muscled, excellently-trained horses, to mow down protestors? Who guessed that in a city of perennial water shortages, we had high-powered water cannons to terrorize Kenyans off the streets?
I am among the most fortunate of the fortunate. Not only am I still whole, alive, healthy, mobile; not only do I have food, shelter, transport, the safety of those I love; I have the gift of work. I have the privilege to be in the company of the most brilliant, principled, brave, resilient Kenyans of my generation. To contribute whatever I can as we organize, analyse, strategize, mobilize, draw on everything we know and can do, to save our country. I marvel at the sheer collective volume of trained intelligence, of skill, expertise, experience, in our meetings. At the ability to rise above personal tragedy – families still hostage in war zones, friends killed, homes overflowing with displaced relatives – to focus on the larger picture and envisage a solution.
I listen to lawyers, social scientists, economists, youth activists, humanitarians; experts on conflict, human rights, governance, disaster relief; to Kenyans across every sector and ethnicity, and I think:
Is this what we have trained all our lives for? To confront this epic catastrophe, caused by a group of old men who have already sucked everything they possibly can out of Kenya, yet will cling until they die to their absolute power?
You know these people too, Mr. Kivuitu. The principled, brave, resilient, brilliant Kenyans. The idealists who took seriously the words we sang as schoolchildren, about building the nation. Some of them worked closely with you, right through the election. Some called you friend. You don’t even have the excuse that Kibaki, or his henchmen, might offer – that of inhabiting a world so removed from ours that they cannot fathom the reality of ordinary Kenyans. You know of the decades of struggle, bloodshed, faith and suffering that went into creating this fragile beautiful thing we called the “democratic space in Kenya.” So you can imagine the ways in which we engage with the unimaginable. We coin new similes:

We joke about the Kivuitu effect – which turns internationalists, pan-Africanists, fervent advocates for the dissolution of borders, into nationalists who cry at the first verse of the national anthem:

Rarely do we allow ourselves pauses, to absorb the enormity of our country shattered, in 7 days. We cry, I think, in private. At least I do. In public, we mourn through irony, persistent humor, and action. Through the exercise of patience, stamina, fortitude, generosity, that humble me to witness. Through the fierce relentless focus of our best energies towards challenges of stomach-churning magnitude.
We tell the stories that aren’t making it into the press. The retired general in Rift Valley sheltering 200 displaced families on his farm. The Muslim Medical Professionals offering free treatment to anyone injured in political protest. We challenge, over and over again, with increasing weariness, the international media coverage that presents this as “tribal warfare”, “ethnic conflict”, for an audience that visualises Africa through Hollywood: Hotel Rwanda, The Last King of Scotland, Blood Diamond.
I wish you’d thought of those people, when you made the choice to betray them. I wish you’d drawn on their courage, their integrity, their clarity, when your own failed you. I wish you’d had the imagination to enter into the lives, the dreams, of 37 million Kenyans.
But, as you’ve probably guessed by now, Mr. Kivuitu, this isn’t really a letter to you at all. This is an attempt to put words to what cannot be expressed in words. To mourn what is too immense to mourn. A clumsy groping for something beyond the word ‘heartbreak’. A futile attempt to communicate what can only be lived, moment by moment. This is a howl of anguish and rage. This is a love letter to a nation. This is a long low keening for my country.

I cannot believe the army is not coming out to repulse the NRA, i can understand not interfering with internal squabbles but a foreign army whatever the reason is unacceptable. all their training is in vain.

Mr. Patel,I cannot say it better than you Mr. Patel. That was an excellent analysis Kenya’s crisis especially the acts of key players and the far reaching effect of their action. The country has a very serious problem of credibility both locally and internationally, people are angry. No amount talk will resolve the problem until justice and peace prevail–the two must go together just as Kibaki and Raila must meet. If the problem of voters riggingwhich is the genesis of current state is not resolved, Kenya will never be the same.
Kalonzo himself know very well that Kibaki did not win why take Musalia’s seat. His presence in the goverment creats more problems than solving them. He must know that even majority of Kikuyus know that the election was rigged. I consulted a Senior Kenyan professor of statistics and he cannot comprehend how Kibaki could win only in one province and divide one with Kalonzo and still beat Raila.I am ashamed of my fellow church leaders and Vice President Kalonzo Musyoka call for peace but leave out justice. Where are the men and women of God who will say ‘thus says the Lord you shall not steal (vote rigging)’ And to Mr. Musyoka shame on you, please for sitting on a chair which Kenyans gave to Musalia Mudavadi at the polls. Why is Kibaki and Kalonzo afraid of mass action? If police comes in peace and do their job then there will be no problem. We all know that the mother of all present evil is simple STOLEN ELECTION . Police must know that they are there to uphold the law, protect the wanainchi. We have seen dangerous sign where police commissioner is making his laws to deny the wanainch their rights.
We must have peaceful match for our freedom. The statement I read reported to have come from Nyanza police chief is very disturbing, she stated that …the only language the people of Nyanza understand is bullet. I hope this will not her line to shoot our people.
And finally, Kalonzo should be the last person to talk about peace. If he had declined the position and focus on justice and peace which,as he articulted eloquently during the campaigns, I truly believe Kibaki would have been forced by the will of the people to meet Odinga by now. I really think Kalonzo is the happiest man in Kenya with this conflict. It has given him the chance to get what he could not get at the ballot, sounded like looting to me or receiving willfully and knowing the product was stolen. Do both you and Kibaki know that almost athousand Kenyans lost their lives because what went on at KICC; the blunt way the rigging was done?

ODM has the support of 102 MPs (including the nominees – i hope they are not barred from voting). The strategy is to make sure that the voting goes to the third round where a simple majority carries the day. ODM is the most balanced party, with a solid 102 MPs, the next thing is to convince North Eastern MPs (mostly KANU) to see that Deputy Speaker is from North Eastern and they should support their own come what may. For Marende, the western vote from Ford-K, New-Ford kenya and other minor parties from western should be convinced to vote in their own. This strategy is dorminatly in favour of ODM. Although too late, a few calls in the morning can work them out.

As a Kikuyu, i fel like an alien on this prticular board. A lot of the things here are true. Democracy is at stake and no president should be sworn in after such a joke of an election. If you learn to separate `kibaki from the kikuyu, then you will see kibaki’s strategy. His moves are aimed as much as killing moderates in central as containing ODM. As long as you lump them together, odm will fail and even if it wins the presidency, it will lose the country to a civil war.

i like that you’d prefer to avoid stereotyping. But then you go ahead and condemn the entire RV which is a type of stereotyping.
i also think that if these sentiments had been expressed prior to the elections they would have carried a lot more weight. as it is right now, there really is no room for moderates and whether you go with PNU or ODM is your choice but you cannot afford to be lukewarm. you already seen the small caucus of moderate MPs was quickly swallowed by PNU.
mass action does not require a majority and if you check history thats just how it is. of course the more people, the larger the impact but mass actions start low key and eventually build up to a critical mass. if at this point in time there are people who still need to be explained to or bargained with to support an ODM action plan then they’ve already missed the boat.
i do not want to bring the RV issue into focus here because whereas I do not condone or support any violence against any Kenyan, that problem has a history which is among the many unresolved/buried issues of our nation that will continue to resurface at the slightest provocation or excuse.
those in support of ODM are in it for principle and yes criminal gangs have taken advantage on both sides but we must continue to fight for the right to holding a free, fair election and ensure that a there is a legitimate conclusion to the entire exercise and uphold the foundations of our fragile and evolving democracy.

The issue of RV being a recurrent issue and hence is ‘ok’ when it happens again is wrong. The rwanda hatred and killings did not start in 1994 but that has not stopped the ICC from taking steps aganist those who organized the killings in 1994. neither did progroms aganist jews start with Hitler but the Nuremberg courts held him and his Nazis accountable for the killing of 6 million jews. past violence is not a ticket to start a fresh round of killings.
Justice i believe is one of the things that you will never get unless you are willing to give it to others. When Raila goes on tv to announce that he will take action aganist the killings in kisumu (with my whole hearted support; no murderer should ever get away), he then goes on BBC to make silly excuses for the murderers who burnt little children in a church, one wonders what sort of a statesman he is.

The injustices which have been glossed over since independence and most recently the vote theft is a time bomb that has been waiting to explode,unfortunately the vote theft triggered the unecessary killings of the innocent adults and children.

To my understanding and I stand to be corrected the killings in RV may not be as a result of the disputed / stolen vote,it is the land problem which the successive governments have refused to address and the disputed vote is being used as an excuse .At the moment the ODM is accussed of being behind the killings but I wonder in any State ,the security of the citizenry is the responsibility of the government.Don’t you think that it could be the government’s game plan as it has happened in the past to cast ODM in negative light?The government is the custodian of all the security apparatus,why is Nairobi not on fire ?to be specific the city centre,how come there is adequate security ,peaceful demonstrators have not been able to access Uhuru Park.
Why was the same level of security not deployed in the RV if the government is not party to the killings .
If there are a few indivinduals masquarading as ODM local officials in RV who are behind the killings they will be dealt with,but what we must understand is that in any confusion of this magnitude criminal elements take advantage to do their business.

We all know Kibaki has never won a Presidential election 1992,1997 he lost and even in 2002 Raila won the elections for Kibaki,so it was obvious to Kibaki and team 2007 he was going to loose and he did,but I remember the last opinion poll released a week to the elections ,where Kibaki apparently was “breathing on Raila’s neck”this was the rigging process in play to physcologically prepare ODM supporters that the election had been predicted to go either way.In that very week KARUME was captured in print and electronic media saying that “Kibaki will be sworn in come what may”,and to his word ,the situation we are in today.
By the way Raila and ODM government though the victory has been delayed would have united Kenyans just like the short lived NARC dream which the same “Crooks”derailed.

Let’s start from here and get your stand before we proceed, this is because the answer to this question then entrenches our thinking from there on end
God help me but this is the first time in 51 years that I am ashamed to be a Kenyan.
On this site I have read people cry against the violence and death of the innocent Kenyan and in the same sentence ask for Guns and Bombs so that they may kill other Kenyans. I have read that this is not a tribal issue and yet find the same historical tribal contempt in the postings. I have read about the proposed distruction of the economy so that the government will not wish to rule a poor nation and I have read that only one side cheated in the elections and always it is the opposing side.
Who is it that has suffered becuase of the actions of ODM and PNU. Has Kibaki or Raila gone home to a burnt house, a destroyed business to a dead wife or child. Have they been driven from their homes in the name of democracy. Have they cried on the street when they have discovered their lives and that of their families destroyed.
In the name of Humanity, becuase surely the way we are acting God will have nothing to do with Kenya again until the mark of Caine is removed from our souls, let’s stop killing each other and calling for violence against our own nation becuase when these men are dead the consequences of the actions that we take today will reverberate through our nation.
Can we not remember what happend to Ghana. When we become a second Somalia will we still blame the other side for the destruction of this country.

I agree. Hold new elections and refuse to let the current leaders stand because of the wonton destruction they have visited upon our Country. They have proved that they are not worthy of our respect. They have shown that they will only lead us to our destruction. In our nation is there no one worthy to lead us or have we got the leaders we deserve. Corrupt, selfish old men who put their arrogance ahead of their people.
I’m pretty sure all members here are of the same opinion that violence is not the answer and that we should stop all forms of this. However I believe one must really take a sober reflection of matters, not just on the 27th but matters as far back from 2002 when Kenya was on the other end of the spectrum and where people wore their Kenyan hats first then tribal hats.
The truth of the matter the system of government in kenya has been one that leaves alot of decisions that affect a vast majority of people in the hands of a few individuals, this is why we have a situation where people’s hopes and dreams are always tied to an individual occupying statehouse. What you fail to understand is that people will always cling to the dream where those shackles will be removed and development/resources will not be tied to whoever occupies the house on the hill.
Another truth is that ODM offered that dream and this time the poor people who represent the vast majority of people came to believe in the dream and believed in the man who proposed to bring this about. This is why you saw the largest voter turnout in history because alot was riding on this elections.
Furthermore tribalism had festered amongst the people and people now wore tribal hats first then alligence to the nation came second. There has been some unresolved issues in Kenya that have never been fully addressed and frankly for the first time you had a candidate talking openly about addressing those issues and correcting those unresolved issues.
Now people then decided to wait for the ballot box and use their voice to speak so as to change their destiny or belief that their destiny will be changed. This was 27th December 2007. Now there has been evidence of Govt commited to rig this election. You yourself I’m sure saw the TV when ballot boxes were being discovered. Incidents including in my home town Mumias of where premarked ballot boxes were discovered and seen live by people in a big businessman’s warehouse to be used in rigging! This was just one incident but they are many more. Further the way people took to defending and protecting the vote by standing vigil for days, setting up roadblocks to inspect cars coming into polling stations was testimony as to the importance.
Now people feel all that was in vain, people feel that they were denied their due, and as a consequence they dream has been shattered. This is an outpouring of anger, and all directed at one tribe in particular. Now this is the cold reality, the bare truth.
Now I do not condone any of this, but feel remorse for all innocent people whom merely exercised thier democratic right to vote for their candidate of choice being killed because of it. Pain as to why thousands of people are being made refugees in their own country, pain that it took the government weeks before they admitted a crisis is underway in the country, pain as a vast sum of people have been made to feel cheated and stripped of any voice they have.
What you must understand is the seeds of hatred are now being planted in our children, the seeds of tribalism planted in all those who saw their parents killed by a friend and neighbour they called “uncle” and importantly the anger and yearning for revenge.
In Mumias, there was a lorry of maize that had been sent there that was to be sold o people and this maize was poisned as revenge for the terrible things that happened to people whom had been brothers and sisters not long back!
For every problem we can not just paint over the cracks, we need to address the very difficult and painful first step in finding truth, then look to rebuild reconciliation that will seek to reprogram the upcoming generation of people to forgive and forge and unite to form one nation and one symbol. Unfortunately given our current system as described earlier, this can only come about through decisions of a few individuals in Nairobi.
Lastly I find it foolish to blame the leaders here, what you should know are in most cases especially immediately following the elections, the reaction was spontenious and the people came out without their politicians having said anything to protest in an eruption of anger. Yes perhaps the politicians thereafter have not been convincing in stopping it, but cynically with the current government, it took that to make them stand up. Whether you believe in the means or not should be your battle with your conscience.
For me this needs to end soon or we shall have a very angry generation breeding and the culmination would be a harvesting of hate and a very unthinkable …..
I have scrolled through the current constitution several times. I need some help to interpret section 55 chapter 3
“”If the National Assembly passes a resolution which is supported by the votes of a majority of all the members of the Assembly…declaring that it has no confidence in the Government of Kenya, and the President does not within three days of the passing of that resolution either resign from his office or dissolve Parliament, Parliament shall stand dissolved on the fourth day following the day on which that resolution was passed”.
Constitution of Kenya, Chapter 3 Section 55 (3) ”
My take is a simple majority gets one home. However some say 2/3 majority, in other sections such as constitutional ammendment it specifically spells out where one needs 2/3 majority whereas here it does not. Can somebody please seek advice from any respectable lawyer they may know and clarify.
My guess is if it is a simple majority, then it is definately an option. Mark my words, Kibaki is not serious about mediation. What we as people can do is tell our MP’s that if they give us another chance we shall fully back them and re-elect them back for the courage of refusing “big money” and giving us another chance of going to the electorate.
I see little risk in MP’s particularly from RV, Western, Nyanza, Coast, NEP and Nairobi, people spoke very loudly and I believe would do again.

while i agree that it is was not the best thing to kill and maim, my reading of the report does not say the violence was organised months before. in fact the witness says that there was a rumor of war in eldoret. then wazee started organising…… I think the blame game is not the matter now. The fact is that we are in a constitutional crisis. Had the politicians not hijacked the bomas process, we may not have found ourselves in this situation. the constitutional moment came and slipped through our fingers. Little did we know that such would come to haunt us. What I see now is the actual constitutional moment reincanait. You remember the discussions that a constitution cannot be replaced in times of peace…. or something like that…..,may be they were right. This is the time that we need to sort out things once and for all. that is the only way we will end up looking at each differently-as kenyans of course. be it ruto you hate, kibaki you like or raila you can compromise. we need each other as a country. but for us to forment that relationship, we need new instituional archtecture that natures social justice. if each, whether community or individual, feels the sense of justice being guaranteed, we will look back and say, “there was no better time than this crisis”.

You guess right we are back to square one ala IPPG of 1997 and 2002 where deals were hammered with the sole intention of trashing them immediately thereafter.
Kibaki DOES NOT mean any good for Kenya and any motion from him is meant to generate no meaningful movement. Annan has already reprimanded him for poisoning his mediation by a belligerent and careful reference to himself as ‘your duly elected President’. You don’t STEAL an election to hand it back, or do you? Kenyans must be aliens from Mars to accept that fallacy.
Make no mistake. No everybody who goes against the current should be cheaply labelled a hardliner. By the way pessimists are not what they are demonized to be but in retrospection they are REALISTS. We cannot and will never solve our problems by sweeping them under the carpet. We must squarely address the genesis of the present turmoil. Cheating ourselves that we are looking at the bigger picture is to engage in self-deception. No forest exists without trees and the former is trivially the sum total of the later.
Short-termism may help cool political temperatures yes but failing to confront our problems head on is to latently and unwitting incubate our national problems which will surely explode sooner rather than later. False confidence
All the talk of power sharing may look rosy in between textbook pages but not for Kenya. The level of hatred has reached irreconcilable proportions. You don’t negotiate with a serial promise broker beholden to a small clique of entrepreneurs who see Kenyans as the providers of a collective back to ride on for their selfish economic enterprises. No more and enough is enough. Raila and co have two choices: either to fight the war to its bitter and logical end or detour and win the ‘winnable’ battle with all the attendant BETRAYAL and loss of goodwill amongst majority of Kenyans.
You don’t have to be a rocket scientist to decipher why a section of Kenyans demonize devolution of any shade – political and economic. Simple, devolution slashes profits and wipes away domination. Once bitten severally shy.
Power games
The Kibaki-Raila handshake was nothing but a smokescreen meant to mean nothing absolutely. The only point of convergence was a hollow mention of the word peace. Otherwise while speaks of JUSTICE and TRUTH, Kibaki take is RECONCILIATION and HEALING. Who is fooling who here? Granted, whoever is right or wrong is spurious in times of war. If we were to be honest with ourselves we would see all this for what it is: POWER GAMES with a predictable outcome.
If Raila by any chance succumbs to pressure and betrays the majority he will be simply repeating history before it is even written. The NARC-LDP betrayals are still raw wounds inflicted by the same players. I wonder whether Rails is ready to jump into that cesspool of MISTRUST and BAD FAITH again. Time will tell and the time of judgment is here. Rails finds himself between the rock and the dark blue sea.
Raila has to prove that his shoulders are large enough for the troubles of his many supporters and NOT just big enough for his ego and political expediency. I don’t envy the man any little bit. But the bottom line remains Raila’s position is not meant for the politically faint hearted. Good luck in the interim.
Can we not fight this in parliament. Kibaki is hiding behind the law, he knows constitutionally he is very protected. Should we not also seek a legal recourse. The constitution seems to say that only a majority is required for a vote of no confidence. If Kibaki is confident he won, then especially with Kalonzo on board he has nothing to fear!

Furthermore intuitively it makes little sense why over 50,000 people in Juja walked into the polls, marked the presidential papers, threw away the parliamentry even though it is one that directly affects their lives at the constituency level. Please

How on earth is it that almost two days after the election was conducted results for Juja were not ready while the one for Kapenguria (with poor infrasture) were completed the same night of voting?
No amount of cooking will legitimise the fraud perpetrated by the former Gema chairman.
In any case, the level of fraud we are talking about is close to .5m votes.
Kibaki is an unmitigated fraudster who must has deliberately ruined Kenya for selfish ends.
Another thing. How comes the ECK never responded to PNU advert alleging irregularities that cost them 95000 votes? It confirms our fears that these conmen have been in cahoots to defraud the people of Kenya.
ODM must have cornered these fraudsters with facts.
The issue of ODM stealing the votes to rationalize the terrible injustice is a sorry excuse.
All the commissioners who handled these election were representative of the PNU despot.
So if they steal 0 .5 m VOTES for themselves and 50,000 votes for us they will achieve their target 0.45m votes. When queries are raised they will counter by saying everyone stole.
We must not buy these spurious arguments designed to legitimise criminal activities perpetrated by the Othaya fraudster.
My suggestion to ANAN is that we have a referendum asking Kenyans if they want to be ruled by Kibaki or Raila. This could pave the way for elections depending on the results of the referendum. The second question should be on whether to adopt MAJIMBOISM or not. But a re-run of the election is still the most viable solution. It is cheaper than the loss of lives even if it is only one more life is lost. Kibaki cannot be disqualified from running for re-election because he is on his first term.

Everyday that goes by that ODm cannot put foward a coherent argurment not even neccecarily in court but even in the press makes me believe tht what ODM is trying to do is wrest power form a man they perceive as being weak.
In addition to the above figures, little mention is the quiet change by ODM that kibaki got 3.7m votes. In their last figures they published, this was quietly changed to 4.1. Explanation? none given.
The AP rigging story which cost the lives of two fficers is hardly mentioned now. its was one of thos oopps!
About Kiambaa and KApenguria, the fact that it kakes longer to count 150,000 votes in Kiambaa as opposed to about 50,000 in Kapenguria is lost to ODMers.

I’m not sure that Kabogo was given by any of us as a credible witness. Secondly why have you not mentioned Molo where the leader of the EU himself personally attests to the fact that what was announced in the constituency was different from that announced at KICC!

Furthermore ask yourself why everybody apart from PNU seems to think the tallying process was flawed? Oh I forgot, they too are in ODM books, both internal and external observers.
Thirdly ODM will not publish all it’s evidence into the public domain, what if there is an impartial judiciary review to be established, any evidence published will not be immersible under any law as evidence, or it’s content can not be heavily relied on.
My question to you is, do you feel that the election was free and fair?
if so, then it explains why we are in this mess, and hence why I feel you and your president will not get us out of this mess any time soon, instead rather engage in theatrics as is the case with the latest Livondo issue.
If it is legitimacy, why doesn’t Kibaki just order re-tallying of all votes under intense scrutiny of observers and media? it will at least give him legitimacy both internally and to some extent externally! ECK should have all the documents so it will be very simple process!

The biggest flaw with ODM is that its crying wolf and when prodded shyies away from pinpointing the wolf. Sure INTL community said there was rigging and sure I imagine they are not ODM but the crucial element that you carefully dance away from is that all these groups say rigging was done by both ODM and PNU.

But At the point we are at, the election hardly seems to be of significant. . it does seem that we are going to have a very blood drenched demarcation of our country. We are locked in a downhill slide that can only end when we hit rock bottom.
Hope that I will still be alive to pick up from where our nation will be at. But the certainlity of a bloody redermacation possibly even split of our country, an resigned myself to that.
There is little Kibaki can do to stem the sheer rage in central.Some even want him to step down to allow for a more ‘manly’ leader to take over.
I have not danced away from the issue. True the international community has alleged rigging by both sides but they were also clear where that it was in the tallying of votes where the most heinous crimes were committed.
Now I will not be partial in my endorsement of these election observers, I can’t be partial in only picking out things that back out my argument and ignore the rest hence I fully accept the fact they said irregularities occurred on both sides.
Let us look at the degree of this. Firstly PNU agents being locked out of ODM zones was irregular and contributed to some of the criticism. Now I may be Naive but where have you had an opposition party being able to rig elections. Now I’m talking about affecting the process of tallying and announcements.
If you are suggesting the latter, my intuition can not accept this. Besides even if somehow this were the case, does that justify PNU tilting the result at KICC?
Surely even if the cynics agree that if you are to rig you do it on the ground, how do you justify what occured at KICC?
I believe this was the key charge on the 2007 Election, the tallying process at KICC. Now ECK was a Kibaki appointed institution that failed in it’s impartiality test, how does ODM go to another where the CJ has already been implicated by being at the Swearing in ceremony. Where does one get confidence.
My questions to you is thus,
Kibaki and yourself are sure you won the elections?
Do you accept the suspiscions surrounding the ECK have destroyed confidence in their annoucements?
Do you also accept that the result sparked off bitter feelings and resentments amongst our people?
Do you accept that serious legitimacy questions in the international eyes remain?
Kibaki is sworn in as the president of Kenya (barring all disputes) he has a duty to protect ALL Kenyans regardless. What has Kibaki done to show leadership in this crisis?
Lastly would it undermine him if he were to open up the books to the results for all to see?
You can not and on a moral grounding just take upon a “wapende wasipende” approach, we are slipping into a unthinkable uncertainty.
Certainty is needed, let him give us that. I can assure you if all is well with the books, ODM will quickly lose the sympathy and goodwill it enjoys internationally. The onus will now be on them to prove in court PNU rigged before hand, a harder preposition.
I am a former Kenyan living in the USA. I was there for 6 weeks from early December to first week in January, visiting family. I also work in toursim selling Kenya to tourists. I am absolutely horrified to see what is going on right now. All the Americans I talk to say how Kenya was always an African nation that has been able to maintain peace. The economy, tourism, etc has been improving greatly and I felt we were finally over the hump of negative publicity that affected tourism after 1998 bombings and tourism in general globally post 9.11.
Now I hear of Luos killing Kikuyu, kikuyu killing Luos. We are now dehumaninzing beloved Kenyans to tribal labels. Visit the Genocide Museum in Kigali. You will see a room dediccated to the children who lost their lives – innocent children. Under each photo you are told the name of the child, his or her favorite food, his or her last memory, and how he or she died. It puts a human face on genocide. These are not Luos or Kikuyus, but mothers, daughters, fathers, sons, grandparents and grandchildren.
I pray for peace. I fear for Kenya. How Long will it take to recover from this mayhem? Who will get the country under control – – call in the army and the next thing is there is a military coup? What is the solution? The leaders of Kenya have failed us. Who is responsible for getting these disparate youth so charged up with hatred they are killing? Did political party propoganda release a time bomb that no one was ready for? Such short sightedness. I say stop pointing fingers at one another Mr. Kibaki and Mr. Odinga and get the country under control. If you really loved your country and your countrymen then this would not have happened. You would have put your egos aside and worked it out and not reduced the country to barbarism.

Am not sure I get what you are asking for. Are you asking for a retallying? because last time I heard about it, it was the goverment, through Amos Wako, who were fronting for a retallying and ODM was demanding nothing less than Kibaki stepping down.
As for the eck having doubts. Let me first say that they are the biggest morons that I know of. I dont know if you are in Kenya but if you are, you would know by now that they have changed their view again and now are sure that there was no rigging. Why you think the doubts or the confidence of these sort of people is worth your consideration is beyond me
I hear you about the courts but ODM’s past records with the courts raises doubts. As late as december ODM was in court challanging the sfaricom IPO. To then turn around and 2/3 weeks later claim the courts are partial seems rather hypocritical to me. Secondly if indeed I have evidence but am afraid that that courts are compromised, should I not push for an independent authority which will hear my evidence (even if its interenationally constituted) so that As I run around the streets uprooting railways lines and hacking innnocent people, I have made My case clear to all and sundry?
ODM call for Kibaki to resign seems to me rather presumptious. A case of ‘start your jail time even while we are figuring out your case’ I believe it goes innocent until proven guilty’
As it is right now, by refusing to present evidence to anyone, ODM seems more like they are interested in pushing for Kibaki to quit rather than proving that a crime has been committed.
